There are three kinds of damages that you may seek in a wrongful death case: economic, noneconomic and punitive.

Economic damages: Your costs and other financial losses resulting from the death of your family member will be calculated so you can recover compensation. This may include past, present and future losses such as medical bills, lost wages and benefits, and loss of their contributions to the household. Reasonable funeral and burial costs are also included.

Noneconomic damages: Your personal losses will also be valued so you can be compensated for your family member’s pain and suffering prior to death, your emotional distress and loss of consortium/the personal loss of a loved one.

Punitive damages: These are awarded in cases of extreme negligence to punish the responsible party and to try to prevent the negligent or felony conduct from happening again.
