Fathers And Child Custody

Mothers and fathers have the same opportunities to obtain custody. The court does not look at the gender of a parent to make custody decisions. In family courts, decisions are made based on what is in the best interests of the child. However, you and the child’s other parent may not necessarily agree on what those best interests are. If you can not reach an agreement, I can represent you in mediation sessions as well as a court proceeding, if needed.

When evaluating what is in the best interests of a child, the following factors will be considered:

  • Parents’ income
  • Living accommodations
  • Ability to provide shelter, food and safety
  • The child’s preference
  • Domestic violence and child neglect
  • Physical and mental health of the parents
  • Parents’ work schedules
  • Chemical dependency or alcohol abuse
  • Current primary caregiver

There are various considerations taken by the court when making these determinations. The most important thing to understand is that one parent does not have an advantage over the other in custody decisions simply based on their gender.
